800K Settlement Obtained in Elder Abuse Lawsuit Against a California Nursing Home

On May 17, 2022, the Plaintiff was admitted to the facility because he suffered from Alzheimer’s and his family could no longer care for him at home. Due to his condition, he needed assistance with all activities of daily living.
Despite being aware of the Plaintiff’s medical needs, the facility failed to provide required care, including leaving him in his urine and feces for extended periods of time, failing to provide him with adequate and proper personal hygiene, failing to turn and reposition him while he was in bed to relieve pressure, and failing to provide him with adequate nutrition and hydration to stave off skin breakdown. As a result, by July 2022, the Plaintiff had developed multiple, avoidable pressure sores that continued to worsen. He was then transferred to Antelope Valley Hospital after being found unresponsive
The Plaintiff suffered these injuries because facility staff did not have adequate time or the inclination to provide him with required care, or to document and address his emergent conditions. His pressure sores were entirely preventable had there been sufficient staff on duty, in both number and competency, to actually implement the protections required by the facility’s own Plan of Care and physician orders.
