Los Angeles Delayed Stroke Treatment Lawyers – Hospital Negligence

Tough representation when California patients suffer delayed treatment for strokes

While strokes are fairly common in Los Angeles and nationwide, many strokes can now be successfully treated with immediate and competent medical care. Emergency room hospital staff, starting with physicians and nurses, should be able to quickly review whether a patient is experiencing the symptoms of a stroke and determine whether life-saving medications such as tissue plasminogen activator (tPA) should be administered. Delays in stroke care in Los Angeles hospitals can cause paralysis, other physical injuries, cognitive impairment, and emotional harm. Strokes, if not treated properly and timely, can be fatal.

Hospitals across Los Angeles should be ready to move quickly if a child, adult, or senior presents with symptoms of a stroke. Time is very critical. At Garcia & Artigliere, our California delayed stroke treatment lawyers understand what safety procedures emergency departments and hospitals should use if they suspect someone is having a stroke. Our lawyers work with physicians who are skilled at determining whether a hospital failed to act responsibly and are also skilled at preparing medical reports and testifying in court. Our Los Angeles trial lawyers have obtained more than $3 billion for victims nationwide since 1993. We’ll explain your rights and fight to show a hospital failed you or your loved one when critical timely care was essential.

What is a stroke?

Kaiser Permanente in Southern California states that a stroke occurs when the blood supply to the brain is disrupted. According to Johns Hopkins Medicine, the stoppage or reduction of blood supply to the brain requires emergency care because the brain needs a constant supply of nutrients and oxygen to work. In just a few minutes, brain cells that don’t receive these chemicals can die. Victims may have difficulty eating, remembering, speaking, controlling their bowels and bladder, thinking, managing their emotions, and controlling critical bodily functions.

There are two types of strokes:

  • Ischemic stroke.  Most strokes are ischemic strokes. Ischemic strokes happen when there is a blockage or narrowing of blood vessels in the brain. Blood clots and cholesterol are common causes of the blockage. Ischemic strokes are classified as thrombotic strokes (caused by blood clots in the blood vessels of the brain) and embolic strokes (caused by blood clots or plaque debris that begin outside the brain and then travel to the blood vessels of the brain).
  • Hemorrhagic stroke. A hemorrhagic stroke involves a blood vessel in the patient’s brain that bursts causing blood to spill into the tissue. Hemorrhagic strokes are categorized as intracerebral hemorrhages and subarachnoid hemorrhages depending on the location of the bleeding.

According to Kaiser Permanente, the risk factors for strokes include diabetes, high blood pressure, tobacco use, high cholesterol, lack of exercise, excess weight, and other risk factors.

What are the signs and symptoms of a stroke?

The symptoms of a stroke include:

  • Problems with balance
  • Difficulty walking
  • Weakness or numbness in the face, arm, leg, or face – often on just one side
  • Dizziness
  • Difficulty seeing
  • Difficulty swallowing
  • Loss of consciousness or seizures
  • Harsh headaches
  • Nausea or sudden vomiting

When are Los Angeles hospitals responsible for delayed treatment of strokes?

Hospitals in Los Angeles should have protocols in place to quickly recognize and treat patients with stroke symptoms. Our lawyers are skilled at showing that hospitals made the following medical mistakes:

  • Failed to recognize that a patient was having a stroke and the type of stroke
  • Delayed the administration of tissue plasminogen activator (tPA)
  • Refused to administer tPA
  • Failed to understand the time limits for stroke treatment, including the effective use of tPA
  • Failed to promptly treat a stroke
  • Refused to believe a patient who was describing stroke symptoms
  • Failed to be able to communicate with the patient through an interpreter if necessary
  • Failed to educate the hospital staff about the signs and symptoms of stroke

The stroke care medical team should understand when clot busters can and should be used. Medical providers should use standard stroke emergency protocols, such as the National Institution of Health Stroke Scale.

Hospitals, physicians, nurses, and other healthcare providers who are responsible for stroke care in a hospital may be liable for the delayed effective treatment of strokes. Hospitals may be liable for improper oversight of stroke care in the hospital and for the negligence of any of their employees.

At Garcia and Artigliere, our Los Angeles trial lawyers argue that diagnosis delays, a missed diagnosis, the failure to anticipate and manage complications, and a failure to prioritize stroke patients are medical malpractice.

How do your Los Angeles stroke negligence lawyers fight for patients and families?

At Garcia & Artigliere, our Los Angeles delayed stroke treatment lawyers understand how different a person’s life is if stroke treatment is timely and effective versus being delayed. Many stroke victims, when stroke care is delayed, live the rest of their life with chronic pain and severe disabilities instead of enjoying all that life has to offer.

Our attorneys work with cardiologists, neurologists, and other medical providers who can review what medical care should have been provided, what wasn’t, and the full health consequences of those failures.

We demand compensation for delayed stroke treatment by hospitals in Los Angeles including the following:

  • Current and future medical expenses, including surgeries and rehabilitative care
  • Lost income and lost employment benefits
  • Physical pain and emotional suffering
  • Loss of bodily function
  • Loff of life’s pleasures

We seek California wrongful death damages for the families of loved ones who died due to delayed stroke treatments. These damages include funeral and burial expenses, the loss of financial support, and the loss of personal guidance and companionship.

In one illustrative case, we obtained a $2,450,000 settlement for an elderly client who suffered injuries due to the misdiagnosis of his stroke by a hospital emergency department and its staff.
