Common types of nursing home negligence

Understaffing and neglect are serious concerns at Harlan Health & Rehabilitation Center, putting residents at risk of harm. When facilities don’t have enough caregivers, the quality of care suffers, leading to dangerous consequences:

  • Without enough staff, residents may not receive adequate food and water, leading to malnutrition and dehydration.
  • Insufficient care can result in painful pressure ulcers and infections due to poor hygiene and prolonged immobility.
  • Overworked staff may give the wrong dosage or forget to administer medication, putting residents’ health in jeopardy.
  • Without proper supervision, residents are more likely to suffer falls, leading to fractures, head injuries, and long-term complications.
  • Neglect can leave residents feeling isolated, anxious, and depressed, affecting their overall well-being.

If your loved one has suffered due to neglect or understaffing at Harlan Health & Rehabilitation Center, legal action may be necessary to hold the facility accountable.

Who is liable for nursing home abuse & neglect at Harlan Health & Rehabilitation Center?

Depending on the specific situation, liability for abuse and neglect at Harlan Health & Rehabilitation Center could fall on multiple parties. Those who might be held responsible include:

  • Nursing home administrators are responsible for ensuring that the facility complies with federal and state regulations. If they fail to enforce care standards or address complaints properly, they can be held accountable for neglect and abuse.
  • Doctors, nurses, and other healthcare providers may be liable if they misdiagnose conditions, administer the wrong medications, or fail to respond appropriately to emergencies. Their negligence can directly impact a resident’s health and safety.
  • If staff members engage in physical, emotional, or financial abuse, they can be held personally accountable for their actions. Abuse by caregivers is a serious breach of trust and can have devastating consequences.
  • Many nursing homes contract third-party companies for medical care, therapy, or maintenance services. If these providers are negligent in their duties or create unsafe conditions, they may share responsibility for the harm caused to residents.
  • If a resident is harmed by a defective medical device or dangerous medication provided by the facility, the manufacturer of these products may be held liable for the harm caused.
  • While not directly liable for abuse, agencies that oversee nursing homes—such as the Kentucky Department of Public Health—may face scrutiny if they fail to enforce regulations or investigate complaints about abuse or neglect.

If your loved one has suffered abuse or neglect at Harlan Health & Rehabilitation Center, legal action may be necessary to hold the facility and responsible parties accountable. Both federal and state laws require skilled nursing facilities to provide sufficient and competent nursing staffing to meet the needs of their census populations.  The federal Centers for Medicare & Medicaid Services (“CMS”) monitor and regulate skilled nursing facilities and their various staffing levels.

In its regulatory role, CMS created the Five-Star Rating System1 that calculates various quality measures based on the data that each facility provides to CMS as part of their respective participation in the Medicare program.

According to CMS, “[n]ursing homes with 5 stars are considered to have much above average quality and nursing homes with 1 star are considered to have quality much below average.”2  Notably, among the most significant factors reviewed by CMS is that “staffing” provided to each facility’s census population.  Based on the data provided to CMS, CMS has determined that Harlan Health and Rehabilitation Center, located at 200 Medical Center Drive in Harlan, Kentucky 40831, garnered an Overall 3 Star rating, which is defined as “average.”3  On April 15, 2021, this facility was cited when the facility failed to “[e]nsure drugs and biologicals used in the facility [were] labeled in accordance with currently accepted professional principles[.]”4
