Common types of nursing home negligence
Nursing home negligence can take many forms, putting residents at risk of serious harm. Common types of nursing home negligence include:
- Failure to provide proper medical care, such as mismanaging medications, delaying treatment, or failing to monitor chronic conditions.
- Nursing homes must take precautions to prevent falls, such as providing mobility aids and proper supervision.
- Neglecting to assist with bathing, changing clothes, or maintaining a clean living space can lead to infections and discomfort.
- Residents may suffer from inadequate nutrition or water intake due to staff neglect or failure to accommodate dietary needs.
- When residents are left in the same position for too long without movement or repositioning, painful and dangerous bed sores can develop.
- Ignoring residents, isolating them from social activities, or failing to provide mental health support can lead to depression and anxiety.
- Delayed responses to medical crises, such as strokes, heart attacks, or infections, can result in severe harm or death.
- Hiring unqualified staff or failing to maintain adequate staffing levels can lead to poor resident care and increased risk of abuse or neglect.
- Failing to properly supervise or care for residents with cognitive impairments can result in wandering, self-harm, or injury.
- Nursing homes must prevent resident elopement (wandering away) and protect against unauthorized access that could lead to harm.

Both federal and state laws require skilled nursing facilities to provide sufficient and competent nursing staffing to meet the needs of their census populations. The federal Centers for Medicare & Medicaid Services (“CMS”) monitors and regulates skilled nursing facilities and their various staffing levels. In its regulatory role, CMS created the Five-Star Rating System[1] that calculates various quality measures based on the data that each facility provides to CMS as part of their respective participation in the Medicare program. According to CMS, “[n]ursing homes with 5 stars are considered to have much above average quality and nursing homes with 1 star are considered to have quality much below average.”[2] Notably, among the most significant factors reviewed by CMS is the “staffing” provided to each facility’s census population.
Based on the data provided to CMS, CMS has determined that Inland Valley Care and Rehabilitation Center located at 250 W. Artesia Street in Pomona, California garnered a 1 Star overall rating and a 2 Star for staffing, which ranks toward the bottom of that scale – “below average.”[3] On May 7, 2021, this facility was cited for numerous deficiencies, which are available to review in inquiring whether those same deficiencies may apply to you or your loved one (e.g., failing to “ensure that a nursing home area is free from accident hazards and provides adequate supervision to prevent accidents,” failure to “provide appropriate pressure ulcer care and prevent new ulcers from developing”, and “develop and implement a complete care plan that meets all the resident's needs….”).[4]
