Common types of nursing home negligence

Understaffing and neglect at nursing homes are serious issues that place residents at significant risk. When there aren’t enough caregivers to meet the needs of the residents, the quality of care deteriorates, leading to harmful outcomes. For example:

  • Inadequate staffing may result in residents not receiving enough food or water, causing malnutrition and dehydration.
  • Poor care can lead to painful pressure ulcers and infections, often due to a lack of hygiene or prolonged immobility.
  • Overburdened staff may administer incorrect dosages or miss medication, putting residents’ health in serious danger.
  • Without proper supervision, residents are at a higher risk of falls, which can cause fractures, head injuries, and long-term complications.
  • Neglect can lead to emotional suffering, leaving residents feeling isolated, anxious, and depressed, which impacts their overall health and happiness.

If your loved one has been harmed by neglect or understaffing at Kennedy Care Center, taking legal action may be necessary to hold the facility accountable.

Who is liable for nursing home abuse & neglect at Kennedy Care Center?

Liability for abuse and neglect at Kennedy Care Center can fall on multiple parties, depending on the specific circumstances. Those who may be held responsible include:

  • Nursing home administrators are tasked with ensuring the facility complies with state and federal regulations. If they fail to enforce care standards or address complaints properly, they may be held accountable for neglect and abuse.
  • Doctors, nurses, and other medical professionals could be liable if they misdiagnose conditions, administer incorrect medications, or fail to respond appropriately in emergencies. Their negligence can directly jeopardize a resident’s health and safety.
  • If staff members are involved in physical, emotional, or financial abuse, they can be held personally accountable for their actions. Abuse by caregivers is a serious breach of trust with potentially devastating consequences.
  • Many nursing homes hire external companies for medical care, therapy, or maintenance services. If these contractors are negligent or create unsafe conditions, they may share responsibility for any harm caused to residents.
  • If a resident is harmed by a defective medical device or dangerous medication provided by the facility, the manufacturer of these products may be held liable.
  • While they may not be directly responsible for abuse, agencies like the California Department of Public Health could face scrutiny if they fail to properly enforce regulations or investigate complaints regarding abuse or neglect.

If your loved one has suffered abuse or neglect at Kennedy Care Center, legal action may be necessary to hold the facility and responsible parties accountable. Our experienced nursing home abuse attorneys are ready to investigate the situation, gather critical evidence, and fight for the justice your family deserves.

Both federal and state laws require skilled nursing facilities to provide sufficient and competent nursing staffing to meet the needs of their census populations. The federal Centers for Medicare & Medicaid Services (“CMS”) monitors and regulates skilled nursing facilities and their various staffing levels. In its regulatory role, CMS created the Five-Star Rating System[1] that calculates various quality measures based on the data that each facility provides to CMS as part of their respective participation in the Medicare program.

According to CMS, “[n]ursing homes with 5 stars are considered to have much above average quality and nursing homes with 1 star are considered to have quality much below average.”[2] Notably, among the most significant factors reviewed by CMS is the “staffing” provided to each facility’s census population. Based on the data provided to CMS, CMS has determined that Kennedy Care Center located at 619 N. Fairfax Avenue, Los Angeles, California garnered a 1 Star overall rating, 1 Star for staffing, and a 1 Star for health inspections, which ranks at the bottom of that scale – “much below average.”[3]

On July 22, 2024, this facility was cited for numerous deficiencies, which are available to review in inquiring whether those same deficiencies may apply to you or your loved one (e.g., failing to “provide appropriate pressure ulcer care and prevent new ulcers from developing,” and “ensure that a nursing home area is free from accident hazards and provides adequate supervision to prevent accidents….”).[4]
